Joseph Barwise of Whitehaven Butcher written 30 Mar 1797

I Joseph Barwise of Whitehaven Butcher, being of sound and perfect mind and memory, do make and publish this my Last Will and Testament in manner and form following (that is to say)

First I give and bequeath unto my two friends Jacob Fletcher of Whinna yeoman and John Bragg of Egermont Butcher all that my Messuage and Tenement situate lying and being at Gillgarron in the Parish of Distington with the Appurtenances, and also my Messuage Tenement and Dwelling House with the Appurtenances situate in Senhouse Street in Whitehaven aforesaid adjoining Hicks Lane on the South side and James Hennel’s House on the North side and Kelsick lane on the West side and all my Shares of Ship’s Rights Credits Goods Chattels Effects and personal Estate whatsoever and wheresoever To Hold to them their Heirs Executors and Administrators respectively according to the several Natures and Tenures there of Upon Trust nevertheless to pay and upon the several Uses Trusts Interests and purchases herein after mentioned expressed and declared of and concerning the same that is to say Upon Trust that my said Trustees do and shall by such means as they think proper pay out of the effects above mentioned all my Just Debts and Funeral Expenses and shall permit and suffer my Wife Susanna Barwise to receive and take the remaining part of the Rents Issues Profits and produce of my said real Estate and Effects to her Own Use during her Natural Life And after my Wife Susanna Barwise’ decease that my aforesaid Trustees Jacob Fletcher and John Bragg or their Heirs Executors and Administrators do sell my Estate at Gillgarron and my house in Senhouse Street both above mentioned and all my personal effects whatsoever as soon as it can be convenient after my Wife’s decease and to pay All the Money that may arise from my Effects as I shall hereafter Will and bequeath.

First I give and bequeath to my Nephew William Barwise the Son of my Brother Joshua Barwise the Sum of Four Hundred Pounds and in case my Nephew William Barwise die before my Wife the aforesaid Four Hundred Pounds be given to his Child or Children to equally divided amongst them, in case there be no Child or Children of my Nephew William Barwise the aforesaid Four Hundred Pounds with all the Money arising out of my Estates and Effects whatsoever I give and bequeath to my Nephew’s and Niece the Children of my Sister Lydia Black and to my Nephews and Nieces Children of my Sister Elizabeth Fletcher and to my Nephews and Nieces Children of my Sister Mary Bouch and to my Nephew son of my Sister Martha Mowson to be equally divided amongst my aforesaid Nephews and Nieces share and share alike, except Ten Guineas I give and bequeath to my trustee Jacob Fletcher and Ten Guineas I give and bequeath to my Trustee John Bragg, and it is my will that my two Trustees may have all reasonable expenses and charges payed out of my Effects for Selling and disposing of my Property.

And I do hereby appoint them the said Jacob Fletcher and John Bragg Joint Executors of this my Last Will and Testament In Trust: hereby revoking all former Wills by me made. In Witness whereof I have hereunto set my Hand and Seal the Twentieth Day of April One Thousand Seven Hundred and Ninety Five.
