In the name of God Amen. I Thomas Barwise of Dubmill not being healthy but I bless God of sound mind and memory, do make constitute and declare this my last will and testament in manner and form following.

First that my funeral expenses and all my debts which I am owing to any person be honestly paid by my executrix hereafter named.

I give and bequeath unto my wife Frances Barwise all my freehold land and mills and every article thereunto appertaining according and in example manner as esquire Burton? conveyed it to Father Osmotherley and as I have surrendered Dubmill's copyhold estate to my wife for son Thomas Barwise at her decease as will appear in the surrender, and if son Thomas should die before he enjoy it then I design my wife and trustees shall make it to Jackson Barwise if living in the same manner as it was intended to Thomas my son.

For being mindful I give my daughter Mary Pearson the sum of £200. I mean to make it up £200 with what she has already received or if my wife and trustees se proper to reserve so much a year interest out of the above for her yearly maintenance and then the stock to go to her children equally at her decease, I am willing any way for the best.

And I want daughter Jane Wise made £200 to what she has received some time or other likewise.

I leave my dear wife Frances Barwise my whole and sole executrix of all that I have owe by any person and of all my goods and chattels moveable and immovable with all power to dispose and do with them as she sees proper in order to give all my children their dividend as I intend to set down.

I design to my daughters Frances, Johanna and Alice Barwise each of them £200 when my wife and trustees see proper that is when they are conveniently situated to receive it.

I hope also my wife has Millhouse Tenement in her own hand that she'll surrender it to Jackson for his use and if she cannot afford him it without something paid out make provision for it in time.

I have given Osmotherley Barwise my eldest son what I can afford and trust in him when I am gone that he'll be a tender and dutiful son to his mother and a kind brother in respect of advice and good offices to all his brothers and sisters.

When I am gone Osmotherley gets Lowsay estate only his mother thirds £10 I would have him let her have without any trouble of taxes or repairs of any kind and as the estate is now let at £90 per year I would have Osmotherley to give his mother during her time £26 per year clear as before and the £300 by bond when she calls.

And as my wife will have great concern upon her and a charge of a small family must beg the assistance of my brother Jeremiah Barwise, my son Osmotherley and Robert Sibson of Old Malbro together with my wife to see every thing fulfilled as near the manner as they take my meaning as possible and in case they want able advice how to settle things regular and for the well being of my family hereafter I hope my wife will assist them with money for the same.

And in case any legacies be left me by my relations that such legacy I bestow wholly upon my wife to dispose of among my children with the advice of my trustees.

NB in case my wife have occasion to sell the mills I would advise and will that she only sell the mills and all the houses such as the dwelling houses kiln, swine houses and other the house which lays upon the South side of the court wall with a joint right to the purchasers together with son Thomas Barwise in feeding upon the sea banks and Bay Meadow.

I mean each dweller to put what goods they please upon that ground as common, and then will that Thomas Barwise my son as he gets my copyhold tenement at Dubmill that he have my freehold houses such as the Hall, dwelling houses, barns, byres and stables, cart houses and all others lying within or North East of the court wall together with Mill Close garden and the ground under Pike Brow which is all freehold and my freehold peat moss only allowing the purchasers 2 days work of peat and 2 days work of turf in the said moss every year if he chooses to dig them.

As with my hand this 1st. day of March 1766,
